11th Court of Appeals Vacates One-to-One Consent Rule
The U.S. Court of Appeals for the Eleventh Circuit postponed the date of the much anticipated one-to-one consent rule to January 26, 2026. The Insurance Marketing Coalition filed a petition arguing that the new rules conflicted with the underlying statute. Additionally, TCPAWorld announced late last week that industry group R.E.A.C.H. filed an emergency FCC petition last week to stay the rule. The IMC noted in a press release immediately after the reversal, “The IMC challenged the new rules because they would have limited consumer choice and imposed significant burdens on businesses, particularly small businesses, in ways that were unnecessary to achieve that goal.” So what does this mean moving ahead and how should marketers proceed moving ahead? Deregulation Ahead: Carr Takes Over the FCC
In other regulatory news, President Trump signed an order designating Brendan Carr as the chairman of the FCC on January 20. Carr, who was initially tapped by Trump in November, noted in a statement, “The FCC has important work ahead—on issues ranging from tech and media regulation to unleashing new opportunities for jobs and growth through agency actions on spectrum, infrastructure, and the space economy. We will also advance America’s national security interests and protect consumers.” Carr announced his key senior staff appointments the following day. TikTok Gets More Time (And Potential Buyers)
Teenagers and performance marketers initially devastated by the recent ban breathed a sigh of relief with last week’s news that the TikTok blackout has been put on hold for 75 days. The extension was followed by news that more potential U.S. buyers have emerged for the ByteDance property. Performance Marketing Insider notes that the blackout period disrupted some ad campaigns and that advertisers spent $4.8 billion running TikTok ads in 2024, up 27% YoY.
