Second Circuit: Subway’s Texts Are Not Robocalls
Earlier this month, the Second Circuit affirmed the dismissal of a suit brought against chain sandwich purveyor Subway. Back in 2016, Subway texted a customer about free chips and, after she replied "STOP" to unsubscribe, they sent a subsequent text sparking the TCPA lawsuit. The Second Circuit Court dismissed the complaint, ruling that Subway’s texts didn’t count as robocalls. They argued that since Subway didn’t randomly generate phone numbers, and texts are not voices, the text was legal. The industry finally receives the guidance that it was looking for; never turn down free chips.
FCC’s Spring Cleaning
The FCC wrapped up its "Spring Cleaning" initiative with a bang, slapping a cease-and-desist order on Alliant Financial, the voice service provider behind an illegal robocall campaign offering debt consolidation loans. The bureau’s crackdown wasn't just a one-off affair; it was a season-long flex of regulatory and enforcement muscle, with the FCC, CFPB, and other agencies teaming up to curb illegal robocalls. FCC Chairwoman Jessica Rosenworcel didn’t mince words, pointing out that scammers have been preying on consumers trying to dig themselves out of debt, with veterans and military families especially vulnerable targets.

Robocall Traffic Continues Steady Decline
U.S. consumers got hit with 4.4 billion robocalls in April—up 3.4% from March, but down 3.1% from last year. Scam calls, however, doubled in April with more than 700 million. Tax scam calls topped the list, with a suspicious claim to erase your tax debt. The monthly report is issued by YouMail, which offers app-based call protection services. "Robocall volume has been relatively steady now for almost six months, despite some month-to-month fluctuations," said YouMail CEO Alex Quilici. "This suggests that the efforts of regulators, and industry, are helping to bring calls down to a significantly lower level than they were even a year ago."
